City of South Perth - Purchase/Alter an Existing Food Business

Applications

When purchasing an existing food business, there are a number of steps required.

All food businesses must:

comply with the following national regulations and standards:
The Food Act 2008
Food Regulations 2009
Australia New Zealand Food Standards Code
have relevant approvals in place
be registered with the City of South Perth.

Settlement enquiry

If the food business you are taking over is currently operating, it is recommended that you undertake a 'settlement enquiry'. The City may carry out an inspection of the premises and provide a written report to the settlement agent, advising of any outstanding work orders and registration fees.

Consent from the owner and/or the owner's settlement agent is required prior to the provision of information.

Refer to the City's Fees & Charges for related fees. Search 'Food Premises Written Report to Settlement Agent on Most Recent Inspection' for the relevant fees.

Operate a food business application

Before constructing or purchasing a food premises or food vehicle of any type, please contact the City's environmental health services for advice. Food premises and vehicles that are not constructed specifically for food handling may require extensive and expensive modifications. Please refer to A Guide to the Construction of Food Premises.

Standards Australia has published AS 4674-2004 Design, Construction and Fit-out of Food Premises. This Standard provides guidance on design, construction and fit-out criteria for new food premises and for the renovation or alteration of existing food premises.

Fees

Refer to the City's Fees & Charges for related fees. Search 'Food Business Notification fee' for the upfront fee.

Further fees are applicable in relation to the food business, including the annual classification fee. Search 'Food Business' for other applicable fees.

This may include an alteration fee if variations apply.

New alfresco dining licence application

Setting up and conducting an alfresco area on City owned or managed land requires an Alfresco Dining Trading Licence. Alfresco areas must be compliant with the City of South Perth Policy P402 Alfresco Dining. Please ensure you read the policy as limitations/site constraints described in the policy may prevent you from having an alfresco area.

Before applying for an Alfresco Dining Trading Licence, please ensure that the proposal and number of seats has been approved by the City's developmental services. Any proposal may be limited by site parking availability and/or number of toilet facilities available for patrons.

Nil fees apply.

Preparing food at home for sale

If you are thinking about preparing food for sale from home, please contact the City's environmental health services on 9474 0777 to discuss your proposal. The City of South Perth will only consider low risk foods when granting permission.

Low risk foods

Jams
Cakes, biscuits, muffins and flour products which do not contain potentially hazardous food such as cream, cheese and/or uncooked egg products
Cake decorating (traditional wedding cakes using fondant decoration only)
Chutneys, relishes and sauces that are heat treated by boiling or cooking
Herb vinegars with a pH of less than 4.5
Repackaging of bulk packaged low risk food products
Pickled onions
Food prepared as part of a Bed & Breakfast. (Additional Development Approval may apply).

Changing food business details or food

If you are proposing to change your business' details (eg change of contact information) or food offering (eg a raw butchery wanting to also sell cooked meat pies), the proprietor must notify the City.

New alfresco dining licence

Please note, a new food business approval application is required prior to approval for an alfresco dining licence application, however both may be submitted together.

Plans and specifications

Please attach via Food Premises Floor Plan/Fitout Detail attachment type, plan specification of the proposed eating area on a scale of 1:50 that includes

Location and dimensions of proposed eating area
The means by which the eating area is to be separated from the balance of the street or public place
The associated food premises, including any seating areas in the private property and number of seats and entrance ways to the premises
Dimensions, levels and slope of the adjacent footpath and any street infrastructure (bins, furniture, bike racks, bollards, signs etc), drainage and Utilities in the immediate vicinity of the food premises.
Location and nature of any parking bays and alignment of the adjacent carriageway.
Position and dimensions of all tables, seats and associated furniture and fixtures proposed to be placed in the eating area

In addition to the above, a site plan showing the eating area and all land and improvements within 30 metres of the boundaries of the eating area including any public facility and parking on a scale of 1:200 is required.

Lodgement guidance

Type of location - property or land?

When lodging your application, you are presented with two options to search the location.

To use the Property search method, click on Property and enter the street number and street name (eg 199 Thelma Street, or 2/203 Thelma Street, or 205B Thelma Street).

To use the Land search method, click on Land and enter the lot number and plan number (eg Lot 3497 DP187254, or Lot 1 SP5985).

Where can I find the lot and plan numbers?

Refer to the Certificate of Title, especially if it has been recently subdivided.

Alternatively, you can refer to the City's mapping tool. Via mapping, search and select the location. Scroll down to the Land - Property Information section via the information to the right of the page. The data for the land search is the Lot on Plan data. You can copy and paste this information into the land search when you start your application.

What if there are no land details in mapping?

How do I attach documents?

The lodgement process may include requirements to attach documents. Please refer to the Before you begin section on this page in relation to requirements and ensure you have this information prior to commencing the process. You will be presented with options for mandatory and optional documentation.

Mandatory documentation

Mandatory document types will be displayed within the mandatory documentation section. There may be more than one document required, and the name of each document will be listed.

To add the document, click the Add button, search and select the correct document then click Open. A pop up will display with your document name as well as the attachment type. Select Save when complete. The document will then be uploaded to the lodgement.

Please note, if you have more than one document for this mandatory field, you can select Add Another via the pop up or Add via the main screen once you have attached the first document.

Complete the process for each mandatory attachment type.

Optional documentation

The lodgement process will also include the ability to attach optional documentation. Please ensure you refer to the Before you begin section of this page for guidance on required documentation as not all may be listed as mandatory.

To attach optional documentation, click the Add button under Optional Attachments, search and select the correct document then click Open. A pop up will display with your document as well as a drop down section to select your Attachment Type. Click the drop down and select the correct type. Select Save when complete. The document will then be uploaded to the lodgement.

Repeat this process for each additional document.

Post lodgement process

Once your application is lodged, the following steps will apply:

Review and assess information, including requesting further information if required
The City's Health Service will arrange an appointment time to ensure that the premises comply with the relevant legislation
The application can take up to 10 business days for a decision.
